Copyright Policy

This Copyright Policy governs the ownership and use of photographs, video, text, logos, designs, data, and other material available on or submitted through the Fish ID Nusantara (“FIN”) website and platform.

FIN is organised by PT Dipa Eralaut Pradana (“DEP”). This policy forms an inseparable part of FIN's Terms and Conditions, Competition Rules, Privacy Policy, and Disclaimer.

This policy is based on the copyright provisions in force in Indonesia, including Law No. 28 of 2014 on Copyright.

1. Material Owned by FIN and DEP

Unless stated otherwise, the copyright and intellectual property rights in the following material are owned by, or lawfully used by, FIN, DEP, or their licensors:

  • The names and visual identities of FIN and DEP;
  • Logos, icons, illustrations, graphics, and design elements;
  • The look and arrangement of the website;
  • Text, articles, guides, forms, infographics, and educational material;
  • Video, animation, audio, and promotional material;
  • The competition structure, administration system, and presentation of information;
  • Databases and the arrangement or compilation of data;
  • FIN publications, presentations, and reports; and
  • Software, code, and digital features developed for FIN.

Nothing in this policy transfers ownership of that material to users.

2. FIN and DEP Logos and Identity

The FIN and DEP logos are official identities protected by copyright, trade mark, and other intellectual property provisions.

The FIN and DEP logos may not be:

  • Altered in shape, colour, proportion, arrangement, or visual elements;
  • Cropped, separated, given added effects, or combined with other logos without permission;
  • Used for commercial activity without written consent;
  • Used so as to suggest official endorsement, sponsorship, partnership, or affiliation;
  • Used on products, souvenirs, clothing, certificates, or promotional material without permission; or
  • Used in any way that could damage the reputation of FIN or DEP.

Sponsors, media partners, dive operators, communities, and other partners may use the logos only in accordance with the brand guidelines and a written cooperation agreement.

3. Use of Website Material

Users are permitted to:

  • Access and read material for personal, non-commercial use;
  • Share links to pages on the FIN website;
  • Share material that FIN has specifically made available for sharing; and
  • Quote limited extracts for education, news reporting, or review, with the source clearly credited.

Unless written permission is obtained, users may not:

  • Copy or republish all or a substantial part of the material;
  • Remove a photographer's name, credit, copyright notice, or watermark;
  • Alter material so that it becomes misleading or damages its original context;
  • Sell, license, or commercially exploit the material;
  • Use the material in another party's advertising, products, campaigns, or promotions;
  • Use bots, scrapers, or automated methods to harvest content in bulk;
  • Build another database or service from FIN material;
  • Use the material to train, develop, or test artificial intelligence systems without written permission; or
  • Use the material in any way that breaks the law or infringes the rights of others.

Crediting the source does not by itself remove the need to obtain permission.

4. Copyright in Participant Photographs

Copyright in photographs submitted to the FIN competition remains with the photographer or the lawful copyright holder.

Participation in FIN does not transfer photographic copyright to FIN or DEP.

Photographers retain the right to use, publish, license, sell, or enter their photographs elsewhere, provided this does not breach a separate agreement made with another party.

5. Participant Representations and Warranties

By uploading or submitting work, participants represent and warrant that:

  • The work is their own creation;
  • They are the photographer or the lawful rights holder;
  • The work does not plagiarise or infringe the rights of others;
  • The work was not obtained through theft, falsified ownership, or unlawful means;
  • They hold any necessary permissions where the work depicts people, brands, property, or material belonging to others;
  • The work is not bound by an exclusive agreement that conflicts with the licence granted to DEP;
  • The photographer's name, location, time, EXIF data, and description of the work are accurate; and
  • Submitting the work breaches neither the competition rules nor the privacy rights of others.

If a third-party claim arises, participants must provide the information and proof of ownership needed to resolve it.

6. Licence to DEP

By uploading work to the FIN platform, participants grant DEP a licence that is:

  • Non-exclusive;
  • Royalty-free;
  • Valid for FIN's purposes;
  • Usable across print and digital media; and
  • Still recognises the participant as the owner of the work.

That licence covers the right to:

  • Display the work on the FIN website and platform;
  • Carry out judging, species identification, moderation, and verification;
  • Display the work on participant profiles and the leaderboard;
  • Announce finalists and winners;
  • Use the work for FIN education, conservation, promotion, publication, documentation, and reporting;
  • Display the work on social media, in presentations, exhibitions, events, books, reports, and FIN publications;
  • Store the work in the competition archive; and
  • Adjust size, format, resolution, layout, or apply limited cropping for the technical needs of publication.

This licence does not give DEP the right to sell ownership of a photograph or to grant a standalone commercial licence to another party beyond those purposes without additional permission from the copyright holder.

7. Limits on Use by Sponsors and Partners

Sponsors, media partners, dive operators, tourism boards, communities, and FIN partners may receive or use participants' work only where:

  • The use relates directly to running or publicising FIN;
  • The photographer is reasonably credited;
  • The material is not altered in a misleading way; and
  • The use is in accordance with their agreement with FIN.

Participants' work may not be used by sponsors or partners as product advertising, packaging, sales promotion, merchandise, or a standalone commercial campaign without separate written permission from the photographer or copyright holder.

8. Photographer Credit

FIN will endeavour to credit the photographer on every use of a work, for example:

Photo: [Photographer Name] / Fish ID Nusantara

Where platform limitations make it impossible to display the credit directly on the image, the credit may appear in the caption, description, contributor list, or a related page.

An accidental error or omission in crediting may be reported to FIN for prompt correction.

Photographers may specify the full name, professional name, or display name used as their credit, provided their official identity remains available for administration and verification.

9. Photographers' Moral Rights

FIN respects creators' moral rights, including the right to be named and the right to protect a work from alterations that damage the creator's honour or reputation.

FIN will not make substantive changes to the content of a photograph without the photographer's consent.

Permitted technical adjustments include:

  • Changes to size and resolution;
  • File format conversion;
  • Limited cropping for layout;
  • Adding a frame, caption, credit, or FIN logo;
  • Compression for website use; and
  • Other adjustments that do not change the meaning or essential character of the work.

10. Withdrawal of Work

Participants may request that work not yet judged or published be withdrawn from the competition, in accordance with the competition rules and stages.

Withdrawing a work may result in:

  • The work no longer earning points;
  • Cancellation of its assessment;
  • A change in ranking; or
  • Cancellation of any award relating to that work.

A withdrawal request does not automatically remove:

  • Publications already printed or distributed;
  • Material already supplied to media before the request was received;
  • Historical documentation of the competition;
  • Records required for audit or dispute resolution; and
  • Backup copies still within the system's deletion cycle.

FIN will cease new use within a reasonable period where required by law or by mutual agreement.

11. Winning Work and the Competition Archive

Finalist and winning photographs may be retained as part of FIN's historical documentation.

FIN may use that work for:

  • Announcing and documenting winners;
  • Competition exhibitions and publications;
  • Educational and conservation material;
  • Programme reports;
  • Presentations to stakeholders; and
  • Promoting subsequent editions of FIN.

Copyright remains with the photographer unless a separate written assignment of rights has been made.

12. Species Data and Scientific Information

Common names, scientific names, conservation categories, locations, observation dates, and scientific facts are fundamentally distinct from photographic works or creative presentation.

FIN claims no exclusive ownership of scientific facts in the public domain. However, the arrangement, selection, verification, grouping, presentation, and compilation of the FIN database may be protected by copyright or other applicable rights.

Limited use of the data for research, education, or conservation is permitted with FIN credited as the source. Bulk data extraction, republication of the database, or commercial use requires written permission.

FIN may restrict publication of the coordinates of certain species to protect wildlife, habitats, and conservation areas.

13. Third-Party Material

The FIN website may contain:

  • Licensed photographs or video;
  • Sponsor and media partner material;
  • Maps;
  • IUCN Red List data;
  • Information from FishBase, WoRMS, Reef Life Survey, iNaturalist, or other scientific sources;
  • Dive operator or partner logos; and
  • Links to or content from third-party platforms.

That material remains the property of its respective rights holders and is subject to the licence or terms of its source.

The presence of third-party material on the FIN website does not grant users permission to copy or use it.

14. Use by Media

Media may use FIN's press releases, programme facts, and official media kit in accordance with the terms accompanying them.

For the use of participants' photographs, high-resolution logos, interviews, video, or other material outside the media kit, media must obtain permission from FIN and, where required, from the relevant copyright holder.

Use for news reporting must:

  • Credit the source;
  • Not alter the context in a misleading way;
  • Not assert a partnership that does not exist; and
  • Not be used as disguised commercial advertising.

15. Material Created for FIN

Rights in material created for FIN by employees, consultants, photographers, designers, agencies, judges, or partners follow their respective written agreements.

Before material is published, DEP must ensure adequate permission or assignment of rights is in place, including for:

  • Digital and print publication;
  • Social media use;
  • Adaptation and resizing;
  • Documentation;
  • Promotion; and
  • Reuse in subsequent FIN activities.

16. Prohibition on Copyright Infringement

FIN may remove, disable, or reject material suspected of:

  • Infringing copyright or moral rights;
  • Using another party's work without permission;
  • Falsifying the photographer's identity;
  • Removing a watermark or credit;
  • Using manipulation to disguise the source of a work;
  • Breaching a third-party licence; or
  • Creating legal risk for FIN, DEP, participants, or others.

Infringement may result in removal of the work, point deductions, disqualification, account suspension, or legal action under applicable law.

17. Reporting Copyright Infringement

Rights holders who believe their work has been used without permission may send a report to:

Email: contact@fish-id.co — Subject: Copyright Infringement Report

A report should include:

  • The reporter's name and contact details;
  • The identity of the copyright holder;
  • A description of the protected work;
  • The link to or location of the allegedly infringing material;
  • Proof of ownership or of authority to act for the rights holder;
  • An explanation of the alleged infringement;
  • A statement that the report is made in good faith; and
  • The action requested.

FIN may request further information before taking action.

18. Handling of Reports

On receiving an adequate report, FIN may:

  • Temporarily restrict access to the material;
  • Request an explanation and evidence from the uploader;
  • Remove or restore the material based on the outcome of its review;
  • Correct the credit or attribution;
  • Facilitate communication between the parties; or
  • Take other action it considers necessary and lawful.

Where an ownership dispute cannot be resolved by FIN, the parties may be asked to settle it by agreement, mediation, or the appropriate legal mechanism.

19. Requests for Permission to Use Material

Requests to use FIN photographs, logos, articles, data, or other material must be made in writing and set out:

  • The material to be used;
  • The purpose of the use;
  • The media and territory of publication;
  • The duration of use;
  • Whether the use is commercial or non-commercial;
  • Any changes to be made;
  • The volume or reach of distribution; and
  • The identity of the party using it.

Permission is granted only once there is written consent from DEP and, where required, from the photographer or relevant rights holder.

20. Changes to This Policy

FIN may update this Copyright Policy to reflect developments in its services, technology, partnerships, competition rules, or the law.

Material changes will be announced on the website or FIN's official channels. Changes will not reduce participants' copyright or retroactively broaden the licence over already-submitted work without a legal basis or the necessary consent.

21. Governing Law

This policy is construed under the laws of the Republic of Indonesia.

Disputes will first be addressed through communication and deliberation. If no resolution is reached, disputes may be settled under an agreed mechanism and applicable law.

This policy is published in Indonesian and English. In the event of any difference in interpretation between the two versions, the Indonesian version prevails.
